  • photo ID
  • divorce papers or a death certificate if relevant

Important point about remote witnessing

The law allows NOIM witnessing in person or remotely by audio and video.

But the witness rules still depend on where you are:

  • if you sign in Australia, the witness must also be in Australia
  • if you sign outside Australia, the witness must also be outside Australia

So if you are overseas, a Melbourne-based celebrant cannot simply witness your NOIM from here. You need the correct overseas witness, such as a notary public or Australian consular or diplomatic officer.
